Service Agreement

This Service Agreement (the "Agreement") is between you, the customer, and MORnet Communications, LLC ("MORnet," "we," "us," "our"). It covers the internet service, voice service, equipment, and support we provide to you (together, the "Service"). By ordering, activating, paying for, or using the Service you accept this Agreement and the policies it incorporates.
1. The Service
Internet. MORnet provides fixed wireless internet access from towers in Central Florida to an antenna installed at your location. Fixed wireless needs a clear line of sight between your antenna and our tower. Trees, new construction, and severe weather can affect it. Plans are sold by maximum ("up to") speed; what affects the speed you see is explained in our Network Management and Performance Disclosure.
Voice. Business voice (hosted phone service) is sold by quote. Its limits, including how 911 works, are described in section 9 and in the 911 Notice.
Residential and business use. Residential plans are for personal and household use at the service address. Running a server for the public, reselling the connection, or sharing it beyond your household requires a business plan.
2. Eligibility and your account
- You must be at least 18 years old and able to enter a contract. A business customer's representative confirms they may bind the business.
- You give us accurate name, address, phone, and email information and keep it current. We use it for billing, service notices, and, for voice, 911 location.
- You are responsible for all use of the Service at your location and on your account, including use by others in your household or business, and for keeping account passwords private.
- If you name authorized users on your account, they may make changes and discuss the account with us.
3. Installation and access to your property
- We confirm serviceability before installing. If we cannot deliver acceptable service at your location, we will tell you and you will not be billed for internet service there.
- If you do not own the property, you confirm you have the owner's permission for the installation, including mounting an antenna and running a cable into the building.
- An adult (18 or older) must be present during installation.
- You give MORnet reasonable access to your property to install, maintain, repair, upgrade, and remove our equipment. Outside of emergencies we will arrange a time with you first.
- A standard installation includes mounting and aiming the outdoor radio, running one cable into the building, and setting up Wi-Fi at one indoor location. Work beyond a standard installation (tall masts, poles, long cable runs, trenching) is quoted before we do it. Installation charges are on the Prices and Fees page.
4. Equipment
- Equipment you buy. The outdoor radio, Wi-Fi router, and other equipment you pay for at installation belong to you. Prices are on your Service Order and the Prices and Fees page. There is no monthly equipment rental.
- Equipment we lend. Equipment we install without charging you for it remains MORnet's property. Do not sell or give it away, and let us collect it when service ends. If it is lost, or damaged by something other than normal wear, lightning, or our own fault, or not made available for collection within 30 days after service ends, we may charge what it costs us to replace it. We will tell you the amount before we bill it.
- Keep the radio in place. Do not move, re-aim, open, or reconfigure the outdoor radio, even if you own it, and do not connect other radios to our towers. The radio's settings must stay under MORnet's management for it to work on our network. Contact us if it needs to move.
- Power. You provide and pay for the electricity that powers the equipment and keep it plugged in. A surge protector or battery backup is strongly recommended in Florida.
- Your own devices. You may connect your own router and devices, as described in the Network Management Disclosure. We are not responsible for equipment we did not supply.
- Warranty. Equipment you buy from us carries its manufacturer's warranty. If it fails in normal use while you are a customer, we will diagnose it at no charge and help you with the manufacturer's replacement.
5. Billing and payment
- Billing. Monthly service is billed in advance, on your billing date, for the month ahead. Your first bill may include a prorated charge for part of a month. Annual and semi-annual prepaid options, where offered, are billed in advance for the whole period.
- Price. Your price is the plan price on your Service Order plus any optional services you choose. Current prices and every fee we charge are on the Prices and Fees page. We do not use introductory rates that expire.
- Taxes. Internet access is not subject to sales tax under federal law. Voice service and equipment sales are subject to applicable taxes, fees, and 911 charges, which are shown on your bill.
- Payment. Payment is due on the bill date. You can pay in the account portal, by phone, or by automatic payment. If you enroll in automatic payment, you authorize MORnet to charge the card or bank account on file for each bill until you cancel automatic payment.
- Late payment. MORnet does not charge late fees or returned payment fees. If we ever introduce one, we will give you at least 30 days' notice first, as section 6 describes.
- Suspension for non-payment. If your balance remains unpaid 7 days after the due date, we may suspend the Service after notice to you. While suspended, web browsing is redirected to a page where you can pay and restore service. Suspension does not stop monthly billing unless you cancel. Service is restored once the past-due balance is paid, with no reconnection fee. If you cannot pay in full, call us before the due date; we would rather set up a payment arrangement than suspend service.
- Billing disputes. If you believe a charge is wrong, contact us within 60 days of the bill date. We will review it, and you do not have to pay the disputed amount while we do. You still pay the undisputed amount.
6. Term, changes, and cancellation
- Month to month. Internet service is month to month with no annual contract and no early termination fee.
- Equipment-funded terms (business voice). If MORnet supplies business phone equipment at no charge, your Service Order sets a minimum term to recover that equipment. Any early termination charge is stated in the Service Order before you sign.
- Cancelling. You may cancel at any time by calling (863) 678-9910 or emailing [email protected]. Cancellation takes effect at the end of the current billing period, and service continues until then; partial months are not refunded. If you prepaid for a longer period, we refund each full unused month.
- Seasonal customers. If you are away part of the year, ask us about pausing service instead of cancelling it.
- Moving. If you move within our coverage area, we will check the new address and move your service; a relocation charge may apply. If the new address cannot be served, you may cancel without penalty.
- Changes by MORnet. We may change prices, plans, or this Agreement. We will give you at least 30 days' notice of a price increase or a change that materially reduces your rights, by email, bill message, or letter. If you do not accept the change, you may cancel before it takes effect without any charge. Continuing to use the Service after that date means you accept the change.
- Termination by MORnet. We may suspend or end Service for non-payment, for violations of the Acceptable Use Policy, for fraud, or if we can no longer serve your location (for example, a tower site is lost). Except in emergencies or for unlawful use, we will give you notice first.
7. Service availability and outage credits
We work to keep the network running and monitor it around the clock, but internet service can be interrupted by weather, lightning, power failures, equipment failure, maintenance, and events outside our control. Planned maintenance is scheduled for low-use hours where possible, and customers enrolled in Outage Text Alerts are told about outages and planned work in their area. Current outages are shown at mornet.zone/status.
Outage credits. If your service is out for more than 24 consecutive hours because of a problem on MORnet's network or equipment, tell us within 30 days and we will credit your account for each full day it was out. Credits do not apply to outages caused by your own equipment, wiring, or power, by suspension for non-payment, or by events described under "Events outside our control" in section 14. The credit is your only remedy for the outage.
8. Your responsibilities and security
- Use the Service in line with the Acceptable Use Policy and the law.
- Secure your own devices and Wi-Fi network with a strong password, and keep software up to date. You are responsible for backing up your own data; we are not responsible for data lost or damaged on your devices.
- If we find that a device on your connection is infected, compromised, or attacking others, we may restrict the connection until it is fixed, and we will tell you what we found.
9. Voice service terms
- 911. Internet phone service handles 911 differently from a traditional landline. It will not work during a power failure or an internet outage, and 911 calls are routed using the address you register with us. Read and follow the 911 Notice; it is part of this Agreement.
- Registered location. Each phone line has a registered 911 address. Tell us before you move a phone to another address so we can update it.
- Number porting. You authorize MORnet to port telephone numbers you tell us you control, and you will give us accurate account information from your current carrier. Porting dates are set by the losing carrier; we will tell you the confirmed date. Cancelling your old service before the port completes can lose the number. If you leave MORnet, we will release your numbers to your new carrier on a valid port request. We do not refuse a port because of a balance owed; any balance remains due, along with any early termination charge in your Service Order.
- Services not included. Unless your Service Order says otherwise, voice service does not include 900 or 976 calls, operator-assisted or collect calls, or international calling. Some alarm systems, fax machines, and medical monitoring devices do not work reliably over internet phone service; test them and keep a backup.
- Fair use. Unlimited calling plans are for normal business calling by the seats you pay for. Autodialing, call centers, and resale need a quoted plan.
10. Warranty disclaimer
Except as stated in this Agreement, the Service and equipment are provided "as is" and "as available." To the extent the law allows, MORnet disclaims all other warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Service will be uninterrupted or error free, that any particular speed will be available at every moment, or that the Service will prevent every security threat.
11. Limitation of liability
To the extent the law allows, MORnet is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption, arising from the Service or equipment, even if we were told they were possible. MORnet's total liability for any claim is limited to the amount you paid for the Service during the three (3) months before the claim arose. These limits do not apply to injury caused by our gross negligence or willful misconduct, or where the law does not allow them.
MORnet is not liable for any failure of 911 service except as the law provides; see the 911 Notice.
12. Indemnity
You agree to cover MORnet's reasonable losses and costs, including attorney fees, from third-party claims caused by your breach of this Agreement or by unlawful use of the Service on your account.
13. Resolving disputes
Most concerns are resolved quickly by calling us at (863) 678-9910. If yours is not, send a written description to the address in section 15 and give us 30 days to try to resolve it.
If we cannot resolve it, either of us may bring the claim in small claims court if it qualifies. Any other lawsuit about the Service or this Agreement must be brought in the state courts located in Polk County, Florida, or the federal court for the Middle District of Florida, and you and MORnet each consent to those courts. To the extent the law allows, you and MORnet each bring claims only on an individual basis, not as part of a class or representative action, and each waives the right to a jury trial. Any claim must be brought within one year after it arises.

14. General terms
- Governing law. This Agreement is governed by federal law and the laws of the State of Florida, without regard to conflict-of-law rules.
- Events outside our control. We are not responsible for failures caused by hurricanes, lightning, fire, flood, utility or power failures, government action, failures of other carriers, acts of vandalism or theft, or other events beyond our reasonable control.
- Notices. We may send notices by email to the address on your account, in the account portal, with your bill, by text where you have agreed, or by mail. You may send notices to the address in section 15.
- Assignment. You may not transfer this Agreement without our consent. We may transfer it to an affiliate or to a buyer of our business, and we will tell you if we do.
- Entire agreement. This Agreement, the incorporated policies, and your Service Order are the whole agreement between us about the Service. If a court finds part of it unenforceable, the rest remains in effect. Our failure to enforce a term is not a waiver of it.
- Copies. The current version of this Agreement and every policy it incorporates is always at mornet.zone/legal. Ask us and we will mail you a copy at no charge.
